Rothwell Figg successfully defended InforLife, S.A. against a Post-Grant Review (PGR) challenge to U.S. Patent No. 12,370,153, which covers a ready-to-use, sterile, preservative-free ketamine infusion product with long-term chemical stability and shelf life.

The petitioner, Par Health, Inc., sought cancellation of all claims in PGR2026-00036, alleging that the patent’s claims were anticipated and obvious. In a Patent Owner’s Preliminary Response, Rothwell Figg rebutted Par Health’s challenges and explained why they were meritless.

On August 13, 2026, the USPTO denied institution of PGR, finding that the petitioner failed to demonstrate it was more likely than not that any challenged claim was unpatentable. The results preserve InforLife’s patent covering next-generation ketamine delivery technology.
