Partner Dan Shores was quoted in the February 25, 2026 Bloomberg Law article “Moderna Royalty Loss Raises Covid-Shot Trial Stakes,” analyzing a recent ruling in the patent dispute between Arbutus Biopharma Corp., Genevant Sciences GmbH, and Moderna Inc. related to Moderna’s Spikevax® COVID-19 vaccine.
Ahead of a March 9 jury trial in the U.S. District Court for the District of Delaware, the court barred Moderna’s damages expert from presenting a reasonable royalty opinion, shifting greater focus to the issue of infringement. Dan noted that the ruling “heightens the importance” of Moderna’s noninfringement defense. Because the court previously required Arbutus to prove literal infringement of certain claims, damages would be irrelevant if Moderna prevails on noninfringement.
