Intellectual property litigation constitutes over 65% of our firm's work as measured by time spent. In addition to prosecuting patent, trademark, and copyright applications for our clients, the firm also provides a litigation team to (1) help enforce our clients' diverse intellectual property rights; and/or (2) defend alleged infringements asserted against our clients.

Our firm has been trial counsel in patent cases in federal courts and administrative agencies around the country involving matters such as treatment of AIDS with AZT, gamma cameras, wastewater treatment and material, plastic modular conveyors, ceiling fan designs, detection of feline immunodeficiency virus, human diagnostic products employing monoclonal antibodies, polymerase chain reaction, a leading heart drug (diltiazem), a leading ulcer drug (cimetidine), an adjunct cancer therapy, catheter technology, corrugated board machinery, voice mail systems, crowd control post designs, semiconductor manufacturing machines, convective blankets, blood testing machines, no till farm implements, and an important new prostate cancer therapy.

We have been lead attorneys in litigation in the trade identity (trademark), copyright and licensing area relating to products as diverse as fishing lures, candy, pharmaceuticals, character rights, publications relating to education, and unique trade identity cases involving color and size of pharmaceuticals and parallel imports. Our firm also handles hundreds of cases in the United States Patent and Trademark Office (PTO) before the Trademark Trial and Appeal Board (TTAB) involving trademark opposition and cancellation proceedings.

Our litigation team includes experienced trial attorneys, as well as a specialized and dedicated support staff with an extensive experience in setting up efficient and effective satellite offices in numerous venues where cases have reached the trial stage.

Our trial team is highly specialized in intricate, multi-party, multi-patent cases, which involve complex scientific and legal issues and extensive discovery, depositions, and millions of pages of documents. We utilize computerized document control and retrieval systems, and work with software installed in-house as well as systems developed by our clients.

While our firm's litigators are aggressive where appropriate, we are also mindful of the high cost and disruption to business associated with litigation. Therefore, where possible, we seek to assist clients in resolving matters which are susceptible to resolution by way of beneficial settlements and alternative dispute resolution (such as mediation and arbitration).
