RFE&M Partner Quoted on Visto Corp. v. Research In Motion Ltd. Case May 8, 2006 – InformationWeek
Rothwell, Figg, Ernst & Manbeck partner Steven Lieberman is quoted by InformationWeek on the Visto Corp. v. Research In Motion Ltd. patent infringement case recently filed in the U.S. District Court for the Eastern District of Texas. On that same day, an Eastern District of Texas judge awarded Visto damages in the amount of $3.6 million in a patent infringement case with rival Seven Networks Inc. Visto, which sells mobile e-mail technology to wireless carriers, is claiming that RIM infringed four of its patents, three of which are the same as those that were at issue in Visto’s case with Seven. RIM believes the patents are invalid and questions Visto’s strategy of suing everyone in the mobile e-mail business, including Microsoft and Good Technology. Earlier this year RIM paid $612.5 million to settle a patent lawsuit with NTP, despite several of NTP’s patents being ruled invalid by the U.S. Patent and Trademark Office.
- But RIM has reason to worry. “It will be more difficult for RIM to disprove the patents because they’ve already been validated in court during the Seven trial,” says attorney Steven Lieberman of Rothwell, Figg, Ernst & Manbeck.
