Rothwell, Figg obtains sanctions against an entity that sought to obtain confidential source information from an award winning newsletter

The Cancer Letter, a long-time client of Rothwell, Figg, is an award winning newsletter covering issues relating to cancer and cancer treatment. In August, 2007, The Cancer Letter received two subpoenas seeking confidential source information arising from an article published by The Cancer Letter concerning a prostate cancer drug that is under regulatory review. The subpoenas were issued on behalf of an entity involved in civil litigation with the United States Food and Drug Administration relating to the approval of that product. After that entity declined to withdraw the subpoenas, The Cancer Letter moved to quash the subpoenas and for sanctions. Rothwell, Figg obtained an order quashing the subpoenas and on February 26, 2008 the United States District Court for the Southern District of Ohio issued an order imposing sanctions on the civil litigant.
