MINAKSI BHATT
Member

Ms. Bhatt has extensive experience in all aspects of intellectual property litigation in the district courts and before the United States Court of Appeals for the Federal Circuit and advising clients on patent and Hatch-Waxman issues.

 

Ms. Bhatt’s experience includes patent litigation in a wide range of technical fields including pharmaceutical, mechanical, e-commerce/business method, and biotechnology patents.  Ms. Bhatt has particular expertise in Hatch-Waxman litigation.  She has handled Hatch-Waxman litigations relating to, inter alia, ranitidine, glyburide, verapamil, paclitaxel, and amlodipine.  Ms. Bhatt’s intellectual property litigation experience also includes design patent infringement, trademark infringement, trade dress infringement, and trademark counterfeiting litigation.

 

Ms. Bhatt advises clients on patent issues, such as validity, enforceability, and infringement; and Hatch-Waxman issues, such as 180-day exclusivity, pediatric exclusivity, and the Medicare Prescription Drug, Improvement, and Modernization Act of 2003.

 

Prior to joining Rothwell Figg Ernst & Manbeck, Ms. Bhatt was a trial attorney with the United States Department of Justice, Antitrust Division, where she worked on investigations relating to intellectual property issues, the computer industry, and mergers.  Prior to attending law school, Ms. Bhatt was a chemist with the Gillette Company.

 

Ms. Bhatt received a B.A. in chemistry from Wellesley College in 1985 and a J.D. from the George Washington University Law School in 1990.  Ms. Bhatt was admitted to the State Bar of California in 1990, the District of Columbia Bar in 1992, and the State Bar of Washington in 2000.  She is also admitted to practice before the Supreme Court, the United States Courts of Appeals for the Federal Circuit and the Ninth Circuit, and the United States District Courts for the Northern District of California, the Central District of California, the Southern District of California, the District of Columbia, and the Western District of Washington.  Ms. Bhatt is also registered to practice before the U.S. Patent and Trademark Office.

 

Ms. Bhatt’s professional memberships include the American Bar Association, the American Intellectual Property Law Association, and the Intellectual Property Owners Association.
